If you are the surviving spouse of a wartime veteran and you are paying out of pocket for help at home, the VA may owe you a monthly check you never claimed. It is called the Survivors Pension with Aid and Attendance, and the maximum for 2026 tops out at roughly $18,697 a year for a surviving spouse with no dependents, or about $1,558 a month. Most eligible families never file. Many learn about it only after spending down the assets that would have qualified them.

Read the Headline Number Correctly

That $18,697 figure is a ceiling, not a payment. The VA calls it the Maximum Annual Pension Rate (MAPR). Your actual pension equals the MAPR minus your countable income, which is essentially your gross annual income from most sources. Almost no one collects the full amount. A survivor with $12,000 in countable income, for example, would receive the difference, not the headline number. Treat the MAPR as a ceiling for calculating your check, not the check itself.

Deduction That Makes This Benefit Winnable

This is the piece most families overlook. Unreimbursed medical expenses, or UME for short, reduce your countable income dollar for dollar once they exceed 5% of the MAPR. That includes things like in-home aides, assisted living fees, prescriptions, Medicare premiums, and long-term care insurance premiums. So a survivor whose income looks too high on paper can still qualify once the cost of her care gets subtracted from the equation. That is why the pension is worth reapplying for when care costs start to spike.

90-Day Rule and Its Fine Print

The service test depends on when the veteran entered active duty. Veterans who entered before September 8, 1980, generally need only 90 days of active service with at least one day during a congressionally defined wartime period. Those who entered on or after that date generally need 24 months of active service or the full period for which they were called up. Wartime periods include World War II, the Korean conflict, the Vietnam era, the Gulf War, and the post-9/11 period. Combat service is not required. Overseas service is not required. A stateside clerk who never left the base can qualify the survivor.

Who the Survivor Has to Be

You need to have been married to the veteran when they passed away, and if you remarried later, that typically ends your eligibility unless the new marriage was annulled or ended. The veteran must also have received a discharge that was not dishonorable. To qualify for the Aid and Attendance rate specifically, you have to need help with daily living activities, be bedridden, live in a nursing home due to physical or mental limitations, or have severe vision impairment. A lower Housebound rate also applies if you are largely confined to your home but do not require hands-on assistance. The legal basis for all of this sits in 38 U.S.C. § 1541 and 38 CFR Part 3.

Net Worth Ceiling and the Gift Trap

A bright-line net worth limit combines assets and annual income. For claims decided in 2026, the ceiling sits near $159,240. Your primary home, one vehicle, and basic household goods are excluded. The trap: the VA applies a 36-month lookback on asset transfers, and gifts or below-market transfers made to children before filing can trigger a penalty period of up to 5 years with no pension payable. Moving money to the kids first is how well-meaning families destroy the benefit.

Do Not Confuse This With DIC

Dependency and Indemnity Compensation (DIC) is a separate benefit for survivors of a service-connected death. DIC is not needs-based, has no income or asset test, and pays a flat monthly rate. You may qualify for one, the other, or neither, and you generally cannot collect both.

Filing Without Getting Fleeced

An entire industry charges families thousands to restructure assets for eligibility, sometimes into annuities that hurt the survivor. Skip it. VA-accredited attorneys, claims agents, and Veterans Service Organizations (VFW, American Legion, DAV) provide the same help at no cost. Gather the marriage certificate, the death certificate, the DD-214, and physician documentation of the aid-and-attendance need.
